Acceptance of Terms

By accessing or using the JustiBuy website and marketplace (the “Service”) you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service. JustiBuy may update these Terms from time to time; material changes will be posted with a new effective date and, where required, notified to users.

About JustiBuy

JustiBuy is an online marketplace that connects buyers and independent sellers. JustiBuy facilitates listing, sale, payment processing, shipping coordination, and related services but does not itself sell products listed by third-party sellers unless explicitly stated.

Eligibility

You must be at least 18 years old and able to form legally binding contracts in your jurisdiction to use the Service. By registering, listing items, or purchasing through the Service, you represent and warrant that you meet these requirements.

Account Registration

To buy or sell on the platform you may be required to create an account. You agree to provide accurate, current, and complete information and to keep account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify JustiBuy immediately of any unauthorized use of your account.

User Conduct

You agree not to use the Service to: – List, sell, or attempt to sell items prohibited by law or by JustiBuy policy. – Provide false, misleading, or infringing information. – Harass, threaten, or abuse other users. – Circumvent fees, manipulate ratings, create multiple accounts to avoid restrictions, or otherwise engage in fraudulent or abusive conduct. JustiBuy reserves the right to suspend or terminate accounts, remove listings, and take legal action where appropriate.

Seller Requirements and Responsibilities

Sellers are independent merchants responsible for: – Ensuring their listings are accurate, lawful, and not misleading. – Setting correct prices, shipping options, and delivery times. – Handling customer service, returns, and refunds according to their own policies and applicable law. – Complying with tax, export, import, and product safety laws. Sellers must not list prohibited items and must comply with JustiBuy’s seller policies. JustiBuy may require identity or business verification (KYC) for sellers.

Buyer Responsibilities

Buyers are responsible for: – Reviewing product descriptions, images, seller ratings, shipping costs, and return policies before purchase. – Paying for orders in full when due. – Providing accurate shipping information and cooperating with sellers during order fulfillment.

Listings and Content

Sellers retain ownership of content they post but grant JustiBuy a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for operation and promotion of the Service. Listings must not infringe third-party rights or contain illegal content. JustiBuy may edit, remove, or refuse any listing at its discretion.

Pricing and Payments

All prices are set by sellers. Buyers pay the total order cost (item price plus shipping, taxes, and any fees). Payments are processed through third-party payment processors such as Stripe and PayPal. By purchasing, you authorize the platform and its payment processors to charge the payment method you provide. JustiBuy charges a platform commission of 1% on transactions; applicable commissions and fees will be deducted per the payment flow configured.

Order Fulfillment, Shipping and Customs

Sellers are responsible for shipping orders in a timely manner using the shipping methods they offer. Buyers are responsible for import duties, taxes, and customs clearance fees where applicable. Sellers must provide required customs information (including HS codes) for international shipments. JustiBuy may provide shipping label purchase services through third-party providers (e.g., EasyPost or Shippo) but is not the carrier and disclaims carrier liability.

Returns and Refunds

Return and refund policies are set by sellers unless otherwise required by law. Buyers should review the seller’s policy before purchase. For disputes, buyers and sellers should attempt resolution through the platform’s messaging and dispute tools. JustiBuy may mediate disputes and may, at its sole discretion, issue refunds or reverse transactions where policy violations or fraud are identified.

Fees and Withdrawals

Sellers may request withdrawals of their available balance using connected payout methods (Stripe, PayPal, or supported bank transfer). Withdrawals may be subject to minimum amounts and processing times. Instant withdrawals (if available) may incur fees (for example, a $2 instant withdrawal fee) which will be deducted from the seller’s balance or charged as specified by the payout provider.

Intellectual Property

All rights, title, and interest in the Service (excluding user content) are owned by JustiBuy or licensed to JustiBuy. You may not copy, reproduce, adapt, or create derivative works of the Service without prior written consent. Users retain ownership of their user-generated content but grant JustiBuy the license described in “Listings and Content.”

Disclaimers

The Service and all content are provided “as is” and “as available” without warranties of any kind, express or implied. JustiBuy does not warrant the accuracy, reliability, or suitability of listings, or that the Service will be uninterrupted or error-free. Use of the Service is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, JustiBuy and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service. In jurisdictions that do not permit limitation of liability, liability will be limited to the greatest extent permitted by law. JustiBuy’s aggregate liability for direct damages will not exceed the amount of fees paid to JustiBuy in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless JustiBuy and its affiliates from any claim, loss, liability, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law, or your use of the Service.

Termination

JustiBuy may suspend or terminate your access to the Service at any time for violations of these Terms, law, or for business reasons. You may close your account by following the account deletion process. Termination does not relieve you of outstanding obligations.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. You and JustiBuy agree to first attempt to resolve disputes informally. If unresolved, disputes may be resolved in the state or federal courts located in Mecklenburg County, North Carolina. If your local consumer protection laws provide additional rights, those laws will apply.

Changes to the Service

JustiBuy may modify, suspend, or discontinue the Service or any part of it at any time without liability. We may also introduce new features or impose limits on certain features.

Third-Party Services

The Service may integrate third-party services (payment processors, shipping providers, analytics) that are governed by their own terms and privacy policies. You agree that JustiBuy is not responsible for third-party practices and that any claims related to third-party services must be brought against those providers.

Prohibited Items

Users must not list or sell items that are illegal, regulated, or otherwise prohibited under JustiBuy policies. This includes, but is not limited to, illegal drugs, weapons, stolen goods, counterfeit items, and items that infringe intellectual property. JustiBuy reserves the right to update the prohibited items list and remove listings that violate policy.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Failure by JustiBuy to enforce any right or provision in these Terms will not constitute a waiver of that right.

Entire Agreement

These Terms, together with the Privacy Policy, vendor terms, and any separate agreements you enter into with JustiBuy, constitute the entire agreement between you and JustiBuy regarding use of the Service.
